Lloyd Knudsen appeals from the post-trial order of the District Court, Seventeenth Judicial District, Phillips County, striking from his cost bill his attorney fees which he sought against Thomas A. Taylor.

The single issue on this appeal is whether Knudsen is entitled to attorney fees under Section 7-17-112(5), MCA. The District Court held that in this case Knudsen is not so entitled. We affirm the District Court.
