JOURNAL ENTRY AND OPINION

{¶ 1} Plaintiff, Paul Posen, appeals the trial court's granting the motions of defendants,1 The Albert M. Higley Company ("Higley"), OccuCenters, Inc. ("OccuCenters"), and Sitecon, LLC. ("Sitecon") for summary judgment.

{¶ 2} In January 2000, The Northeast Ohio Regional Sewer District-Westerly Waste Water Treatment Plant ("NORSD") solicited construction bids for work to be done at its water treatment facility. Much of the work involved the containment and/or removal of lead from the site. Higley was selected as the general construction contractor for the project.…
