STAKELY, Justice.

In this case there is a bill for a declaratory judgment filed by Victor S. Rice and Sarah S. Rice (appellees) against John D. Winslett (appellant).

The main controversy in the case grows out of an alleged oral agreement between John D. Winslett and the Rices made in connection with a written contract for the sale of certain real estate in Perry County, Alabama. The allegations of the bill show that the Rices purchased from Winslett certain farm lands for which they agreed to-pay the sum of $48,200.
