This is a suit brought under the Miner’s Act to recover damages resulting from the death of plaintiff in error’s intestate, who was a miner, and was injured while at work in the mine of defendant in error on the twenty-seventh day of June, 1911. He died on the fourteenth day of November, 1911. The declaration filed consisted of four statutory counts. Bach count of the declaration is predicated upon the provisions of the Miner’s Act of 1899 and section 29 of the Miner’s Act of 1911 (J. & A. ft 7503).
