Klein, J.), entered January 17, 1989, which granted defendants’ motions at the close of plaintiff’s direct case to dismiss the complaint for failure to establish a prima facie case (CPLR 4401), unanimously modified, on the law, to the extent of denying the motion as to defendant Knolls Ambulance Service, vacating the judgment in its favor and remanding the action against it to Supreme Court for a new trial and, except as so modified, affirmed, with costs.
