Plaintiff pro se Kevin O’Rourke appeals from a judgment of the United States District Court for the Southern District of New York, Kimba M. Wood, Judge, dismissing his amended complaint (“Complaint”) against defendants Smithsonian Institution and its operating unit the Smithsonian Institution Press (collectively the “Smithsonian”) for copyright infringement. The district court granted the Smithsonian’s motion to dismiss for lack of subject matter jurisdiction on the ground that 28 U.S.C. § 1498(b) gives the United States Court of Federal Claims exclusive jurisdiction…
