MEMORANDUM OPINION

SMALKIN, District Judge.

This employment discrimination case has not run an easy course. After the Court granted the defendants’ original motion for summary judgment on grounds of legislative immunity, the Fourth Circuit changed the law by its decision in Berkley v. Common Council of Charleston, 63 F.3d 295 (4th Cir.1995) (en banc), cert. denied, — U.S. -, 116 S.Ct. 775, 133 L.Ed.2d 727 (1996).
