MARCUS, District Judge.

THIS MATTER comes before the Court pursuant to Defendants’ Motion to Dismiss or in the alternative for Summary Judgment as to Count II of the Complaint, and Plaintiffs’ Third Motion for Enlargement of Time in which to serve Defendants. For the reasons set forth at length below, Defendants’ Motion to Dismiss Count II is GRANTED, Defendants’ Motion for Summary Judgment as to Count II is DENIED AS MOOT, and Plaintiffs’ Third Motion for Enlargement of Time in which to serve Defendants is GRANTED.
