Appeal from a judgment of the County Court of *980Albany County (Herrick, J.), rendered June 26, 2002, convicting defendant upon his plea of guilty of the crime of robbery in the second degree.

Defendant pleaded guilty to robbery in the second degree in satisfaction of a three-count indictment. Under the terms of the plea agreement, he was to be sentenced to a nine-year prison term to be followed by a five-year period of postrelease supervision, and waive his right to appeal.
