The appellant and Thomas Hollihan were presented and jointly indicted by the grand jury of the city of Baltimore, at the January Term, 1873, of the Criminal Court of Baltimore, for the murder of Mrs. Mary Ann Lampley, on the second day of January, 1873. The indictment was in the usual form of an indictment for murder.

It appears by the record that the appellant was indicted for murder, jointly with Thomas Hollihan, and a verdict of lCguilty of murder in the first degree” was rendered against each of the prisoners.
In the course of the trial, an exception was taken by the counsel for the appellant, to the ruling of the Circuit. Court, which is now before us for review on this appeal.
