Appeal from Monroe county court. Action by William H. Muckle against the Rochester Railway Company for personal injuries. From a judgment entered on a verdict in favor of plaintiff, and from an order denying a motion for a new trial, defendant appeals.

The action is to recover damages for an alleged assault upon the plaintiff while a passenger in one of the defendant’s *733cars. In the afternoon of March 17, 1892, the plaintiff took passage upon an Exchange street car, going to what is known as the “Four Corners,” where he desired to take a West avenue car; paid his fare; asked for and received a transfer for that car. The plaintiff, at the Corners, hoarded a West avenue car, and when he presented the transfer ticket to the conductor the latter refused to receive it, for the reason that it was past the time within which it was available, and…
