This matter is before the court in the nature of a case stated. The facts are as follows:

By deed dated April 13,1926, recorded in Centre County, in Deed Book, vol. 136, at page 76, D. Harvey Pontius and Minnie H. Pontius, his wife, conveyed parts of lots nos. 50 and 51, in the plot or plan of Beaver Lawn Addition to State College Borough, to Rebecca H. Leathers.
