This action filed by Plaintiff Michael J. Modjeska (“Modjeska”), a former employee of Defendant United Parcel Service, Inc. (“UPS”), comes before the Court on UPS’s motion for summary judgment (ECF No. 33) dismissing Modjeska’s claims under the Americans with Disabilities Act of 1990, as amended in 2008, 42 U.S.C. § 12101 et seq.
