In an action to recover damages, inter alia, for wrongful death, battery and false arrest, plaintiff appeals from a judgment of the Supreme Court, Queens County (Lonschein, J.), entered March 17,1981, *543which is in favor of defendant Alexander’s, Inc., upon a jury verdict. Judgment reversed, on the law, and as between plaintiff and Alexander’s, action severed and new trial granted, with costs to abide the event.
