— This is a proceeding brought in this court by the territory of Arizona, upon the relation of the .attorney general, to compel the tax collector of Cochise county to institute a suit pursuant to Act No. 92, p. 162, of the Laws of the Twenty-second Legislative Assembly (Laws 1903), to collect delinquent taxes from the Copper Queen Consolidated Mining Company, a corporation. The issues before us are of law; the facts appearing in the pleadings of the respective parties.
