OPINION

DAUGHTREY, Judge.

The defendant, Van David Pride, was convicted of second degree murder in the shooting death of his brother, Alvin (Alvie Joe) Pride. He was also found guilty of employing a firearm in the offense. At a separate hearing, he was sentenced to 40 years imprisonment, enhanced by a five year sentence for use of a firearm.
