The defendant, Fidelity-Phenix Fire Insurance Company, was awarded this writ to a $2,000.00 judgment obtained by Roy Nash, assignor, et al., in a proeeeding by notice of motion for judgment on an insurance policy.

Tbe plaintiff, Roy Nash, had, for some time prior to January, 1927, conducted a general mercantile business in the City of Bluefield, West Virginia, under the name of “Nash Grocery Company”.
