The issue in this case is whether the insured is entitled to recover under a marine insurance policy where either he or his agent misrepresented a material fact on the insurance application and where the policy excluded losses incurred during a race or in preparation for a race. Plaintiff Certain Underwriters at Lloyds, London (Lloyds) argues that under federal maritime law the insurance policy it issued to Etienne Giroire was void ab initio and may be rescinded…
