This is'a writ of error'to'the Circuit Court of the district of Maryland. The.original action-was brought by the plaintiffs in error against the defendants, upon a policy of-insurance.under Written by the defendants, whereby “ they caused Thom as Te nant, for whom it may concern, to'he insured, lost or not lost,at and from Havre de Grace to New-Orleans, with liberty to touch and trade at Havana;” ten thousand dollars upon brig Creole and "appurtenances. The declaration averred the interest, in the plaintiffs, and a total loss by the perils of the seas.…
