This action was begun by appellee, as plaintiff, against appellants, as defendants, on or about July 9, 1904, in the United States Court for the Southern District of the Indian Territory at Ardmore, to recover the sum of $2,000 damages. A trial was had and judgment was rendered in favor of the ap-pellee against the defendants. The case was appealed by defendants to the United States Court of Appeals of the Indian Territory, at South McAlester, and the case was pending on the docket of said court at the time of the admission of the state into the Union, and was transferred to this court under…
