POLOZOLA, District Judge.

This matter is before the court on the motion of Bill Ledbetter to remand this suit to state court. No oral argument is required on this motion.

Ledbetter was the Louisiana distributor for Justice Brothers Distributing Co., Inc., until January 18, 1985, when his distribution contract was terminated. J.D. Tindle was then awarded the new Justice distribution contract. Thereafter, Ledbetter allegedly continued to hold himself out as the Justice distributor.
