Appeal from an order and judgment of the Supreme Court (Duskas, J.), entered December 15, 1992 in St. Lawrence County, which granted defendant’s motion for summary judgment dismissing the complaint.
In 1964, defendant acquired certain real property located in the City of Ogdensburg, St. Lawrence County, for the purpose of developing an industrial park. This action concerns a 12-acre portion of that property that defendant sought to have developed as a retail factory outlet center.
