This is an application to vacate and set aside a judgment of this court entered June 3, 1932, upon an order dismissing the claim of the above-entitled claimant upon the ground that such claim failed to allege facts sufficient to constitute a cause of action against the State of New York. No appeal from such judgment of dismissal was prosecuted by the claimant. The application is based upon an alleged error of law.
