Robert Schmelz as guardian of an incompetent, James Michael Schmelz, filed this suit against Monroe County, Florida, Sheriff J. Allison Defoor, and Jody Baker and Jeffrey Koppin, employees of the Sheriff’s Department, in the United States District Court for the Southern District of Florida seeking damages pursuant to the provisions of 42 U.S.C. § 1983 and which arose out of injuries to James Michael Schmelz while incarcerated in the Monroe County jail.
