On April 24, 1996, George Albrecht, the president of the plaintiff, Nissan Automobiles of Marlborough, Inc. (Nissan), signed a lease agreement to open a Nissan dealership on premises owned by the defendant, Allen M. Click. After attempting twice to exercise the purchase option in the lease agreement, Nissan filed a complaint seeking a declaratory judgment and specific performance of the option to purchase the premises.
