1Evidence: memoranda: conditions of admissibility. I. The witness Lambert testified that, in the fall of 1910, he took the application of plaintiff for sickness and accident insurance; that the application was taken in duplicate; that plaintiff signed one and not the °ther; that the signed application was transmitted to the insurer in the state of New York, and that witness does not know where it now is.
