Appeal from a judgment of the Supreme Court (Seibert, Jr., J.), entered February 20, 2004 in Saratoga County, ordering, inter alia, equitable distribution of the parties’ marital property, upon a decision of the court.

The parties were married in May 1972 and have three children, one of whom is not emancipated. On May 11, 2001, plaintiff commenced this action for a divorce alleging, among other things, cruel and inhuman treatment.
