This matter is before the Court on the Motion for Summary Judgment (Filing No. 149) filed by Plaintiff Union Pacific Railroad Company (“UP”), and the Motions for Summary Judgment filed by Defendant Beemac Trucking, LLC (“Bee-mac”) (Filing No. 147), and Defendants Landstar Ranger, Inc. (“Landstar”), and Edward Samuel Edling (“Edling”) (Filing No. 144). For the reasons discussed below, all three motions will be granted in part and denied in part.
