This is a proceeding under article 79 of the Civil Practice Act for an accounting and for the construction of a trust and an amendment thereto, and for other incidental relief.

Pursuant to a deed of trust dated June 1, 1918 (hereinafter referred to as the 1918 Trust) one Cornelia Haven Peabody-transferred certain securities having a face value of $325,000 in trust for the support and maintenance of her children and grandchildren, and designated her husband, Stephen Peabody, as sole trustee.
