In a proceeding under article 79 of the Civil Practice Act for the construction of an inter vivos trust, and for other relief, petitioners appeal from so much of an order as construed the trust and referred certain issues raised by the objections to the successor individual trustee’s account to a referee to hear and determine. The trust was established by Cornelia Haven Peabody in 1918, for the maintenance and support of her children and grandchildren, her husband Stephen Peabody being named as sole trustee.
