This appeal concerns the Estate of the late Ben J. Altheimer, who died testate, a resident of Jefferson County, Arkansas, on May 29,1946; and is a “three-cornered” suit between (a) the Guardian of the incompetent son of the Testator; (b) the Foundation Trustees; and (c) the Testamentary Trustees. The appellant in the present litigation is Elsie J. Selig, co-guardian 1 of the person and estate of Ben J. Altheimer, Jr., an incompetent.
