This case is a direct appeal proceeding asserting that there is prejudicial error in a judgment rendered by the district court of Crook County in an action brought by Harry L. Scoggin, Roger D. Thomas, Imogene C. Thomas, Ernest Scoggin, Elverda Scoggin, James T. McGuckin, Claire C. McGuckin, Elsa J. Scog-gin, L. J. Brimmer, K. M. Brimmer, George E. Jolley, Millicent E. Jolley, and Lewis A.
