In this case there w;as a recovery by the appellee (plaintiff) against the appellant (defendant) for $2,500 for injuries alleged to have been received November 18, 1905, in an accident caused by a defective sidewalk. The plaintiff at the time of the accident was between six and seven years of age. The case was tried before the court and a jury.
