The plaintiff, Isaac N. Dean, whilst crossing the tracks of the defendant company’s road at Frost station, Fayette county, in a wagon, on the morning of the 25th of November, 1882, was struck by the locomotive of a passing train, and this suit was brought to recover damages for the injury sustained through the alleged negligence of the defendant on that occasion.
