This is an action brought under St. 1887, c. 270, § 2, to recover damages for the death of the plaintiff’s intestate through an alleged defect in the condition of the defendant’s ways. The question is whether the cause of the accident is within the statute. The deceased was killed by being knocked off a car of the defendant’s by a slanting bridge or chute over the track between two buildings of the Washburn and Moen Manufacturing Company in its yard.
