By this motion defendant requests dismissal of the amended claim herein on the ground that the same was not timely filed.

This action arises out of allegedly slanderous and libelous statements made about claimants by employees of the New York State Department of Health during the review of an application for transfer of ownership of a residential health care facility operated by claimants.
