TIMBERS, District Judge.*

Defendants Aleide L. Chaloux and the United States having moved, pursuant to Rule 12 (b)(6), Fed.R.Civ.P., to dismiss the actions1 for failure to state a claim upon which relief can be granted, and the United States also having moved, pursuant to Rule 12(b)(1), Fed.R.Civ. P., to dismiss the actions as to said defendant for lack of jurisdiction over the subject matter; and
