In July, 1926, the defendant-appellant SprattSnyder Company obtained a judgment against the plaintiff-appellee, F. H. Dunbar. Thereafter, execution issued to satisfy the judgment, and the defendant-appellant Anson Barrett, a constable, levied upon appellee’s radio receiving set. Within due time before the sale, appellee served upon the constable a notice to release said receiving set, on the theory that it was a musical instrument, and therefore exempt, under Section 11760 of the 1924 Code.
