■ On September 26, 1933, Catherine Moriarty instituted this action against T. M. Howard, Jr., alleging in her petition that, on January 1, 1930, T. M. Howard, Sr., and defendant executed and delivered to her a note of that date whereby they each promised, and agreed to pay to her, one day after date, $4,134.37 with interest at 5 per cent. p°er annum; that thereafter and within about a week they delivered the note to her; that it was under r stood by all parties that defendant and his father, T.
