Before the court is defendant’s Motion for Protective Order Limiting the Scope of the Deposition of John Tillotson (doc. 113). Plaintiff has filed a response opposing defendant’s motion. Defendant has filed a reply.

On April 19, 1991, plaintiff filed this action against Midland Fumigant, Inc. (“Midland”) alleging trademark infringement and unfair competition. Subsequently, a settlement was reached and the case was dismissed in June 1992. In March of 1994, plaintiff moved to vacate the dismissal on the grounds that defendant had…
