MEMORANDUM AND ORDER ON STATE DEFENDANTS’ MOTION TO DISMISS

SKINNER, District Judge.

Introduction

Plaintiffs brought this action under the Civil Rights Act of 1871, 42 U.S.C. § 1983, alleging that the conditions of their confinement in the Norfolk County Jail and House of Correction (“jail”), violated their constitutional rights. On January 17,1984, I issued a Memorandum and Order in which I found that certain conditions at the jail did violate the plaintiffs’ constitutional rights, and I granted a preliminary injunction requiring, inter alia, that the number of prisoners at the jail at any one…
