Plaintiff appeals from a judgment in favor of defendant in an action for damages arising from the refusal of said defendant (sometimes referred to as “the company” or “respondent”), to reinstate a noncancellable policy of insurance. The policy in question was issued to plaintiff on April 11, 1924, and provided for payment of $250 per month in the event of accidental injury or sickness, and the sum of $25,000 in the event of accidental death.
