These motions arise out of Plaintiffs action for injunctive and other relief brought pursuant to the Commodity Exchange Act, 7 U.S.C. § 13(a)~l (2001). On October 1, 2003 the U.S. Commodity Futures Trading Commission (“CFTC” or “Plaintiff’) filed a complaint against Defendants A.S. Templeton Group, Inc.
