MEMORANDUM OPINION

HUDSON, District Judge.

On September 20, 1999, Petitioner, Robin McKennel Lovitt (“Lovitt”), was convicted in the Circuit Court for Arlington County of both robbery and capital murder. Following a sentencing hearing on March 1, 2000, and in accordance with the jury verdict, Lovitt was sentenced to death. Thereafter, on both direct appeal and in collateral state proceedings, Lovitt unsuccessfully challenged his death sentence.
