Appeal, No. 266, Oct. T,, 1911, by defendant, from judgment of C. P. Delaware Co., March T., 1910, No. 145, on verdict for plaintiff in case of Jane B. Horne v. John Hancock Mutual Life Insurance Company. Assumpsit upon a policy of life insurance. Before Broomall, J. The facts are stated in the opinion of the Superior Court. Verdict and judgment for plaintiff for $203.48. Defendant appealed. Error assigned was in giving binding instructions for defendant.

The single assignment of error complains of the refusal by the learned trial judge to direct a verdict for the defendant. The action was founded on a policy of insurance on the life of William C. Horne, the husband of the plaintiff, who is the beneficiary named in that policy. It contained the usual provision that it should not become effective until it had been actually delivered to the insured and the first premium by him paid while in good health.
