Appellees, the chairman and four members of the Executive Committee of the Magoffin County Democratic Party (hereafter County Committee), sued the Magof-fin County Board of Election Commissioners (hereafter Board), its members, the sheriff and clerk of that county. The action was for the purpose of resolving a controversy over election officers appointed to represent the Democratic Party at the polls at the general election on November 4, 1969.1 Petitioners sought mandatory relief and a declaration of rights.
