Pearl 0 ’Loug-hlin was convicted in the Denver district court of murder in the first deg’ree and sentenced to life imprisonment at hard labor in the state penitentiary, to review which this writ is prosecuted.

Her assignments of error will be g'rouped and considered as follows: (1) Sufficiency of the evidence; (2) the admissibility of the testimony of her husband, Leo *3700 ’Loughlin; (3) the opening statement of the district attorney; (4) the admissibility of the testimony of Captain Clark; (5) refusal to permit defendant to make a statement not under oath.
