Crane and Christopher Crane against the Oregon Railroad & Navigation Company, to recover the possession of real property and damages for withholding the same. The facts are that George Crane died in the year 1901, and left surviving Susan Crane, his widow, and Alonzo, Alfred "W., and Christopher Crane, his sons, the plaintiffs herein.

1. A motion to dismiss the plaintiffs’ appeal has been interposed on the ground that since the judgment was rendered the controversy involved in the action has been settled by the parties. It appears from affidavits and other writings submitted with the motion and supplemental thereto that the plaintiffs Alonzo Crane and his brother, Alfred, on November 27, 1908, executed to their mother, the plaintiff Susan Crane,’ a power of attorney, authorizing her to sell any of their real property in Oregon and to execute to the purchaser the necessary deeds therefor.
