SOPER, Circuit Judge.

This suit on a comprehensive liability insurance policy was brought by Atlantic Building Corporation, the insured, against Glens Falls Indemnity Company to recover the sum of $2,700 paid by the insured in settlement of a suit for damages for assault and battery brought by Margaret Steel Fallaw against the insured and Tom E. Mat-lack in the Court of Common Pleas for Richland County, South Carolina, and also to recover the sum of $750 for attorney’s fees expended in defense of the suit.
