A motion has been made to dismiss the writ of error in this case for want of jurisdiction.

The mase as it comes before us is this: Many, the defendant in error, in the., year 1848, recovered a judgment in the Circuit Court for the District of Massachusetts, against-the plaintiffs in ' error, in an action for the infringement of certain letters-patent. The verdict and judgment was for less than $2,000, but the writ of error to remove the case to this court was allowed under the patent law of 1836.
